These terms are concluded between the company POULET INTERACTIVE, a SASU with a capital of 1,000 euros, registered with the RCS of Montauban under SIRET number 999 401 292 00019, whose registered office is located at 10 rue Jean Doumerc, 82000 Montauban, France (hereinafter "the Publisher"), and any natural or legal person (hereinafter "the User") wishing to access the LocalProse software.
These General Terms of Use and Sale (hereinafter "Terms of Service") govern the access, use, and subscription to the services provided by the Publisher of the LocalProse application. They cover :
Any account creation, subscription, or use of the application implies unreserved acceptance of these Terms of Service. The User confirms this acceptance by checking the dedicated box during registration or subscription.
Software Provision : To ensure optimal speed and high availability of installation files (which are large), the Publisher reserves the right to use third-party specialized distribution infrastructures (CDN or release platforms). The User agrees that the download may take place via these secure third-party servers.
The installation of the LocalProse software is free. However, to access the interface and use the software, the User must create a user account via the form integrated into the application (requiring a valid email address and password).
Once the account is created, the User benefits by default from the "Free Account" status.
Although data processing is local, an active internet connection is required at application startup for User authentication and license validity verification (Free or Pro status).
As LocalProse software relies on a "Local First" architecture (data processing directly on the User's device without sending it to a cloud), its performance — specifically AI text generation speed or voice dictation responsiveness — depends exclusively on the hardware power of the User's computer (CPU, GPU, RAM).
The Publisher recommends a recent and powerful hardware configuration for optimal use of artificial intelligence functions.
The User is invited to test the software's performance on their machine via the "Free Account" before any subscription. Consequently, the Publisher cannot be held responsible for slow execution, latency, or a degraded experience related to insufficient or obsolete hardware configuration.
Limitation on testing advanced features
The User is expressly informed that certain advanced features, particularly those based on local artificial intelligence and voice dictation (Speech-to-Text), are exclusively accessible under the Pro subscription and cannot be activated under the Free Account.
Therefore, the Free Account only allows for evaluating the general interface, software stability, and overall compatibility with the User's system, without constituting an exhaustive performance test of advanced features.
The User acknowledges that the subscription to the Pro offer is made with full knowledge of the facts, as the performance of these features depends exclusively on the hardware capabilities of their equipment. No request for refund, early termination, or compensation may be based on insufficient performance or inability to execute related to the User's hardware configuration.
Use of the software with a "Free Account" is provided free of charge, without financial consideration.
The User can subscribe to the "Pro" offer to unlock advanced features.
Free trial period : Every first subscription to the Pro plan systematically begins with a seven (7) day free trial period. During this period, the User accesses all Pro features without being charged.
Post-trial pricing : At the end of the 7 days, unless canceled early by the User, the subscription automatically becomes paid. The rate applied will be the one chosen during subscription (monthly or yearly), as displayed on the localprose.com website. Prices are calculated including applicable taxes (VAT) according to the User's country of residence via our payment partner Stripe. The Publisher reserves the right to modify its rates for future periods, provided the User is informed in advance.
Subscription requires registering a valid payment method (credit/debit card) via the secure provider Stripe.
Payment failures : In the event of a failed charge (insufficient balance, expired card), the Pro subscription will be suspended, and the account will revert to "Free Account" status.
The 7-day trial offer is strictly limited to one (1) use per natural person and per computer terminal.
To enforce this limitation and prevent abuse (creating multiple accounts to stack trial periods), the User agrees that the LocalProse application collects and processes a unique technical identifier derived from their hardware (Hardware ID / Digital Fingerprint).
This identifier is hashed (anonymized) and used exclusively to verify the terminal's eligibility for a new trial period. The Publisher reserves the right to refuse trial activation or suspend access if it detects that a terminal has already benefited from this offer, even with a different email address.
The Pro subscription has no long-term commitment. It is automatically renewed at the end of each period (every month for the monthly plan, every year for the yearly plan).
The User can terminate their Pro subscription at any time from the "My Account" section within the application.
To be processed before the next automatic renewal, the termination request must be made at least twenty-four (24) hours before the expiration date of the current period.
Important : Terminating the financial subscription stops future payments but does not delete your user account. To exercise your right to be forgotten and permanently delete your account and personal data, please consult our Privacy Policy or contact Support.
In accordance with applicable consumer law (specifically Article L.221-28 of the French Consumer Code), the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer's express prior agreement.
However, LocalProse goes beyond legal obligations by offering a 7-day Trial Period.
This trial period serves as the User's reflection period. During these 7 days, the User may withdraw without cost or justification by simply canceling their subscription within the application.
Waiver after trial : Failure to cancel before the end of the 7th day constitutes the User's acknowledgement that the full service has been fully executed and consumed. The User expressly waives their right of withdrawal for the upcoming paid period, as the contract is then definitively sealed for the duration subscribed.
The Publisher grants the User a personal, non-exclusive, non-transferable, and worldwide license to use the LocalProse software.
Whether the account is Free or Pro, it is strictly forbidden to engage in any form of reverse engineering, circumvent the technical limitations of the Free version, resell, or sub-license the software.
The Publisher regularly evolves the software (corrective or evolutionary updates). While most updates are optional, some may be critical and mandatory, specifically to:
Access restriction : The User agrees that the Publisher reserves the right to temporarily block access to the software interface (security mechanism) if the installed version is obsolete and can no longer guarantee the required security or operational conditions.
To regain access to the service, the User must download and install the latest available version (free update).
This temporary unavailability, inherent to necessary technical maintenance, shall not give rise to any compensation, refund, or extension of the current subscription, as the update time depends on the User's diligence and internet connection.
One of the fundamental values of LocalProse is the writer's sovereignty over their texts.
The application is provided "as is". The Publisher undertakes to provide its services with diligence and according to industry standards (obligation of means).
The Publisher attaches great importance to privacy.

The Publisher reserves the right to modify these terms at any time to adapt them to legislative, regulatory, or technical changes in the service.
In the event of a substantial modification, Users will be informed (via email or notification). To ensure informed consent, the Publisher may invalidate current sessions.
During their next connection to the software, the User will be invited to review the new version of the Terms of Service and expressly accept them (via the login form or a dedicated checkbox) to continue accessing their account and the service. Refusal of the new terms will prevent further access to the account.
Consequences of refusal for Pro subscribers :
Refusal of new terms blocks access to the software interface, making it impossible to access the self-service termination feature via the "My Account" section. This refusal does not trigger automatic subscription termination with the payment provider.
Therefore, a subscribed User who refuses new Terms of Service must immediately contact support at Support to request the termination of their subscription. The Publisher shall not be liable for subscription renewal if the User has not performed this specific step following their refusal of the terms.
These Terms of Service are governed by French law.
In case of a dispute between the User and the Publisher, they shall endeavor to resolve it amicably (the User shall send a written complaint to the Publisher or, if applicable, to the Publisher's Customer Relations Service at: Support).
In the absence of an amicable agreement or response from the Publisher within a reasonable period of one (1) month, a User who is a consumer within the meaning of Article L.612-2 of the French Consumer Code has the possibility to refer the matter free of charge, if a disagreement persists, to the competent mediator.
